1. Introduction

Welcome to PublicServiceArcade ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at publicservicearcade.sbs (the "Service") operated by PublicServiceArcade.

By booking a charter or accessing our Service, you consent to these Terms. If you do not agree with any part of the terms, you must not use the Service.

2. Service Overview

PublicServiceArcade offers a range of luxury yacht charter services, including:

• Daily yacht charters
• Evening cruises
• Business events
• Private celebrations
• Extended charters

Our services are provided based on availability and subject to weather conditions. We may alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

• Be of minimum 18 years old
• Supply truthful and complete details
• Make a deposit as indicated in your reservation confirmation
• Agree to these Terms & Conditions

3.2 Confirmation

Confirmation of your reservation occurs solely after payment has been made and our written validation is issued. We reserve the right to deny service to anybody at our discretion.

3.3 Availability

All yacht reservations are dependent on boat availability and acceptable weather conditions. We will make reasonable attempts to accommodate your requested dates and times.

4. Payment Terms

4.1 Pricing

All listed prices are in $ and are inclusive of taxes unless specified otherwise. Prices may change without previous announcement.

4.2 Payment Schedule

• Deposit: 50% of the total charter expense is required at booking time
• Remaining balance: Must be paid 48 hours prior to the charter's start
• Any extra charges (if applicable): To be paid after the charter concludes

4.3 Payment Methods

We accept a variety of payment methods, including the major credit cards, electronic funds transfers, and certified checks. Payments are processed via secure and encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund except for processing fees
• Between 24 to 72 hours before departure: 50% of charter fee refunded
• Within 24 hours of departure: No refund is provided

5.2 Weather Cancellations

In case we deem weather conditions unsafe, we propose either:

• Rescheduling the charter without extra fees
• A complete refund if rescheduling is not an option

5.3 Mechanical Issues

Should there be mechanical problems with the designated yacht, we will strive to offer a comparable replacement. If a replacement is not feasible, you will receive a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests need to:

• Obey all commands from the crew
• Put on provided safety gear as necessary
• Inform us about any health conditions that might impact safety
• Stay within designated areas aboard

6.2 Prohibited Items

The following items are not permitted aboard:

• Glass containers
• Illegal substances
• Weapons of any kind
• Excessively intoxicating substances (beyond moderate consumption)
• Animals (unless prior permission has been granted)

6.3 Conduct

Guests are expected to behave respectfully. Should any passenger's conduct create a security threat or interrupt the experience of others, we can end the service immediately without reimbursement.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost you paid for the charter. We are not responsible for:

• Injuries due to passengers’ own carelessness
• Damage or loss of personal items
• Indirect or punitive damages
• Delays because of weather or unforeseen situations beyond our command

7.2 Insurance

We have a comprehensive marine insurance policy for our yachts and operations. Passengers should have their own insurance for travel and personal belongings.

7.3 Risk Acceptance

Participation in our yacht services means you understand there are risks involved with maritime activities and you agree to assume responsibility for your own safety.

8. Modifications and Itinerary Changes

We hold the right to alter itineraries, paths, or schedules due to weather, safety considerations, or operational demands. We will endeavor to provide similar experiences whenever possible.

9. Force Majeure

We are not accountable for any hold-ups, cancellations, or changes that result from forces beyond our control, like:

• Extreme weather spells
• Natural calamities
• Government edicts
• Ports being inaccessible
• Vessel breakdowns

10. Privacy and Data Protection

Your personal data is processed according to our Privacy Policy. You consent to the collection and usage of your data as outlined in our Privacy Policy when using our services.

11. Intellectual Property

All content on our website, such as text, designs, logos, and pictures, is under copyright and trademark protection. Unauthorized copying, distribution, or creation of derivative works is not permitted without our express authorization.

12. Governing Law

The application of these Terms is governed by the jurisdictional laws of United States Virgin Islands. Legal disputes shall be deliberated in the courts of Charlotte Amalie, United States Virgin Islands.

13. Changes to Terms

We hold the authority to update these Terms at any given time. Any amendments will be published on our website with a new revision date. Your continued patronage of our services constitutes agreement to the amended terms.
